For the last several days, I have been sleeping on a cold concrete floor covered by a thin layer of carpet in a Marshalltown warming center, and I will be sleeping on a cold concrete floor again tonight. I have evidence that I will be presenting to the Iowa Civil Rights Commission and the United States Department of Justice showing that the service-connected, statewide mental health disability discrimination I have experienced across the State of Iowa from 2018–2025 traces back, through an evidentiary record of public records, to the City of Marshalltown’s investigation conducted by former Marshalltown Detective Tejada. The City’s own public records show that investigation targeted my service-connected mental health disabilities and was supported by zero evidence.
City of Marshalltown Police Department:
Let us face the facts. You had false allegations of harassment and threats from two Caucasian women during the height of the #MeToo movement, and you still could not produce an arrest under a section of the Iowa Code as vague as Iowa Code § 708.7(4)(a), which states:
“4. a. Any other act of harassment is harassment in the third degree.”
Why is all of this historical evidence relevant years later?
Because the evidence supports that the City of Marshalltown, IA, Police Department:
1. Disregarded alleged violations of the law within the same chapter of the Iowa Code (Iowa Code Chapter 708, Assault) when those violations were reported by a male citizen with mental health disabilities (gender/disability).
2. The evidence supports that the City of Marshalltown, IA applies different evidentiary requirements based upon the protected class of the reporter when comparing alleged violations of Iowa Code Chapter 708 reported by a female party (2019) with alleged criminal conduct within the same chapter of the Iowa Code reported by a male citizen with mental health disabilities (gender/disability) (2025).
3. The evidence supports that the City of Marshalltown, IA, failed to provide law enforcement accommodations at a mental health drop-in center regarding alleged domestic abuse reported by a male citizen with mental health disabilities.
I have archives of statewide documented evidence and will continue to present it. I will not remain idle or silent while human beings are forced to sleep on a cold concrete floor with only a thin layer of carpet as a result of the choices of the City of Marshalltown, IA’s leadership.
I would like to close this correspondence with the following:
Would the leadership of the City of Marshalltown, IA like to provide evidence of its humanity by dropping off ten (10) cots and halting what I believe the evidence will ultimately support is the City of Marshalltown’s harassment and discrimination affecting protected classes (including disability) within the Mid-IA Triumph Recovery Center?
Or, Fire Marshal Warnell, would you prefer to have a conversation with me on body camera tomorrow while I explain how I, with a United States Navy service-connected 20-percent back disability, have been sleeping on a cold concrete floor with only a thin layer of carpet while your firefighters sleep in beds in your new Public Safety Building?
I have been directed to lock the doors at 2200. That gives you approximately ninety minutes to drop off ten cots so that I can accommodate members of our community who, based on the evidence, have been persecuted, criminalized, and denied equal access to public accommodations, rights, and liberties within the City of Marshalltown, IA.
I was a firefighter on the USS Princeton in Repair 2 and Damage Control qualified on every platform on which I served. The value of your uniform, Fire Marshal Warnell, is equal to the sum of your Acts, not the illusions you manufacture for yourself.
