Evidence Supporting Excessive Iowa Government Body Fees IAW Iowa Code Section 22.3

Waukee Schools – Fee: $140 – Note: This fee is nearly identical to the fee requested by the City of Waukee, IA, reported and documented in a previous complaint. This uniformity suggests that there is a method behind this fee. At the same time, the requested amount, in comparison to state-wide evidence, indicates that both government bodies only require education on the actual time needed to perform this search and how to provide a proper response in the event a search of requested keywords produces a sum of electronic documents that may require a more significant fee due to legal analysis fees in accordance with Iowa Code Section 22.7. Government body employees can only responsibly and ethically report a fee for an electronic records search once they have identified the quantity of data (records) they have on file.

Iowa Government Body failure or refusal to respond to a public records request in accordance with Iowa Code Chapter 22 by approximately 94% (309 of 327) of Iowa public school districts.

One of the most striking anomalies regarding the Iowa Public Information Board’s handling of recent events is represented by the evidence that shows the originator of this complaint was transmitting state-wide record requests over a year before this alleged public information board made the reckless decision to persecute, criminalize, and attack the service-connected mental health disabilities of this records requester.

The evidence shows that on 11 APR 2022, the originator of this complaint sent a record request to all Iowa public school districts requesting public records, including the name of Iowa State University employee Sara N. Merritt. An employee of Iowa State University, whom evidence across the States of California, Iowa, and Montana shows was involved in a coordinated act involving concealing two children from court-ordered appearances at San Diego East County Superior Court for case ED100465. At the same time, the evidence shows Sara N. Merritt was involved in a malicious scheme involving multiple allegations of sexual abuse that the San Diego East County Superior Court (ED100465), the San Diego County Sheriff, and the United States Navy have all documented there is zero evidence supporting these allegations maliciously spread by Claudia J. Bergman (f.k.a Claudia J. Merritt, a.k.a as Claudia J. Alatorre, a.k.a CJ Soulful) recklessly, immorally, and unethically across the states of California and Iowa before she reported it to San Diego East County Superior Court. At the same time, the evidence of Claudia J. Bergman’s historical conduct provides a reasonable conclusion that she only sought maximum financial gain out of a civil court case while maliciously destroying the mental health of a former spouse with no regard for the lives of the children she claimed to love that she was negatively impacting.

Before the late summer 2023 actions of Iowa Public Information Board Executive Director Eckley, Iowa Public Information Board members, and other private and public officials who chose to participate in this malicious abortion of equal access to constitutional and civil rights, the chart below shows that 65% of all Iowa public school districts in 2022 completed a request for public records related to Sara N. Merritt. The sum of the 31 JAN 2024 record requests after the evidence showing the malicious acts of the Iowa Public Information Board shows an approximate 59% decline in completed records requests compared to the 11 APR 2022 records requests. Note: Public records provided by Iowa public school districts that will be added to the below database in upcoming weeks show that Sara N. Merritt, an Education Director at Iowa State University’s Reiman Gardens, coordinates field trips for other Iowa parent’s children to attend field trips at this Iowa State University property. The question that needs to be asked that evidence shows the leadership of the State of Iowa and Iowa State University have been ignoring: Should an Education Director that evidence shows has been involved in the concealment of children, non-court authorized custody, interstate transfer of children concealed from the court, and involvement in false allegations of sexual abuse involving children be allowed to mentor and lead other Iowa parents children during tax-funded educational events. If this is inappropriate, contact Iowa State University and ask them for public records, including my name, and ask why the evidence indicates they have continued to allow Sara N. Merritt to continue to lead, mentor, and coordinate educational events for other people’s children when the evidence shows she has been involved in abusive acts toward children Sara N. Merritt was not authorized to have custody of.

The above electronic mail shows Iowa Public Information Board Executive Director Eckley including the Iowa Association of School Boards in electronic mail correspondence during the preparation of presenting the proposed Iowa Code Section 23.8A Vexatious requester petition to the public at the 15 SEP 2023 IPIB legislative committee meeting.

Iowa Public Information Board Deputy Director Toresdahl communicated, “I don’t think there is any accusation of a crime” and “That’s not an accusation of a crime.”

Evidence supporting that Iowa Public Information Board Deputy Director Toresdahl’s analysis of the historical record misrepresents the available evidence and that the Iowa Public Information Board Executive Director indirectly falsely accused the originator of this correspondence of a criminal act during the 15 SEP 2023 IPIB public meeting and attempted to criminalize the originator of this correspondence by name in electronic mail correspondence is supported by the following evidence:

“We’ve had some issues with individuals filing hundreds of requests and engaging in abuse – what many would consider abusive and harassing conduct related to those,” Eckley told the committee. “And so looking at it there’s not a lot that individuals can do if they’re in that situation. There’s very little that they can do other than to continue to just take the harassment and continue to have to review the information from that individual to make sure they are complying with their (Open Records Law) requirements.”

“I’m not sure if it’s 100 for one specific agency, but there have been hundreds sent out by — across the state — quite extensive,” she said.”

“Merritt is making 1000s of records requests to
government entities. He has a right to do that. The concern I have is
that he has stated he wants to develop a database of the government
email systems, etc.” She wrote that she was concerned about the
“potential harm that could be done if there is a database that shares
information that could be useful to others to harm these
government systems if bad actors were able to use the information
to insert malware of ransomware.”

“She added that she has “become aware of an individual basically automating across all counties, all school boards, all cities, and such, seeking extensive records and then the communications after that can be quite abusive and harassing.

Eckley declined to identify the person who is making the “automated” requests and abusive comments, although she acknowledged the records requests are, themselves, considered to be public documents in Iowa.

The below correspondence from Iowa Public Information Board Executive Director Erika Eckley provides evidence of her identification of the originator of this correspondence as the source of automated correspondence across the State of Iowa related to public records requests and complaints with the Iowa Public Information Board. (Note: Evidence in the form of DNS entries in the electronic mail header of the Iowa Public Information Board complaint responses shows the Iowa Public Information Board utilizes automation services provided by Salesforce Inc. Evidence also indicates the Iowa Civil Rights Commission and the Office of the Ombudsman also use some form of automation with their correspondence (specifically responses to submitted complaints).

“I guess that the purpose (of the draft legislation) is to look at if there are ways that we can prevent front-line employees from significant harassing behavior or other things that make it so that they’re not able to do the job, their main job for government,” she said. “It’s not to prevent individuals from filing requests. Legal Disclaimer: In this case, an indirect false allegation of criminal conduct articulates the evidence supporting the Iowa Public Information Board Executive Director verbally and publicly communicated (public meeting) an alleged act of criminal conduct (Iowa Code Section 708.7) without mentioning someone’s name. At the same time, the actions described by the Iowa Public Information Board Executive Director during the public meeting on 15 SEP 2023 supporting this alleged criminal conduct correlate with the Executive Director’s electronic correspondence with organizations across the State of Iowa while articulating and describing the same actions in public records where the Executive Director mentions the name of the citizen of the State of Iowa (Michael J. Merritt) that is being targeted.

Ultimately, by correlating the Iowa Public Information Board Executive Director’s public communications as documented by the Iowa Press during the Iowa Public Information Board’s public meeting on 15 SEP 2023 and in electronic mail public records, it is reasonably determined the actual citizen the Executive Director was communicating an allegation of criminal conduct against while the Executive Director was attempting to expand the political power of the Iowa Public Information Board Executive Director’s position and the Iowa Public Information Board. At the same time, the evidence supports a reasonable conclusion the Iowa Public Information Board Executive Director intended to misrepresent the content of public records and deploy a false allegation of criminal conduct to the Iowa Legislature as justification for why the Executive Director and her government body required additional political power that would have allowed the Iowa Public Information Board to restrict citizen’s rights to request public records from a specific Iowa government body for up to one year while violating the citizens of Iowa’s constitutional right to due process.

I respectfully submit to the leadership of the State of Iowa it is my faith in Jesus Christ and twenty years of military training that restrains me from communicating what I fucking feel regarding losing my children within the country that I served for twenty years. At the same time, those I served that I have asked for help, the evidence shows, have spent more time attempting to criminalize me while trying to cover their ass as opposed to helping save the lives of someone else.

To the elite that spread false narratives, including words like vexatious, you have only provided evidence that you have no understanding of the word. Do you think my daughter felt she was with someone who was vexatious? At the same time, she was drugged and sexually assaulted in the environment the evidence shows this country abandoned her in (as documented on public records, the City of Newton, IA, attempted to conceal, and Jasper County, IA, Attorney Nicholson has attempted to cover up).

Has every Veteran that has committed suicide or been haunted by thoughts of it; were they ruled by vexatious thoughts that their lives had no value, that their country did not want them, and that there was no future?
